Article 48 of Disability Law

The Authority shall be competent to perform all activities and tasks that ensure the care of persons with disabilities 1( Added pursuant to Law No. 73 of 2020. and their habilitation, particularly the following: 1- Approving the general policy for the care of persons with disabilities and following up reports on its implementation and development. 2- Establishing rules for identifying the basic needs for the care and habilitation of persons with disabilities. 3- Establishing regulations and determining procedures relating to implementing the State’s obligations stipulated in this Law. 4- Preparing and supervising implementation of an integrated action plan encompassing all matters relating to the care and habilitation of persons with disabilities in the short and long term, in coordination with the relevant State agencies. 5- Forming the necessary committees to undertake study, organisation, preparation, submission of proposals and follow-up activities, and determining the powers of these committees. 6- Accepting unconditional assistance and gifts and determining how they are to be spent. 7- Establishing rules and systems for managing funds allocated to the affairs of persons with disabilities and determining the avenues for their investment. 8- Proposing laws relating to the care and habilitation of persons with disabilities. 9- Approving the annual plan for participation in local and international conferences and meetings and the exchange of expertise and information in the field of care and habilitation of persons with disabilities. 10- Studying and following up international and regional conventions concerned with the affairs of persons with disabilities and expressing opinions on accession thereto, in coordination with the relevant entities. 11- Encouraging scientific research, conducting surveys and statistical studies, and exchanging information and expertise in the fields of disability among the relevant competent local and international entities within their specified legal frameworks. 12- Establishing the integrated plans and programmes necessary to provide local personnel and train them scientifically and practically in methods of care and habilitation of persons with disabilities. 13- Guaranteeing the rights of children with disabilities, building their capacities, developing their skills and promoting their inclusion in society. 14- Establishing a statistical database concerning persons with disabilities to ensure that the State’s development plans and programmes encompass all their particular needs and services. 15- Guaranteeing equal opportunities and non-discrimination in rights on the basis of disability, drawing upon the experiences of other countries in the fields of care for persons with disabilities and safeguarding their rights, and cooperating with entities concerned with the rights of persons with disabilities to provide means of support for persons with disabilities and their care, habilitation and rehabilitation. 16- Submitting an annual report on the Authority’s activities to the National Assembly and the Council of Ministers concerning what was implemented during the past year and what is planned for the coming year. 17- Establishing clear scientific standards for diagnosing disability and applying them. These standards shall be available on the Authority’s website.
