Article 255 of Bankruptcy Law

The company’s manager or liquidator may not submit an application to commence proceedings pursuant to the provisions of Law Index 1446 Home Page Bankruptcy Law Law No. 71 of 2020 Promulgating the Bankruptcy Law this Law except after obtaining approval therefor from a majority of the partners in a general partnership and a majority of the general partners in a limited partnership, from the owner-partner in a single-person company, and from the extraordinary general assembly in other companies. The trustee’s approval shall suffice in respect of judicial composition. The application must include the names of the general partners at the time the application is submitted and those who left the company after it ceased payment, stating the domicile and nationality of each general partner and the date of registration of the announcement of that partner’s departure from the company in the commercial register.
