Article 253 of Bankruptcy Law

Either spouse—whatever financial regime is followed in the marriage—may recover from the other's assets his or her movable and immovable property upon proving ownership thereof. Such property shall remain encumbered by the rights lawfully acquired over it by third parties. If the recovery application is submitted after the issuance of the decision opening declaration-of-bankruptcy proceedings, the property claimed may not be delivered to the recovery applicant except after obtaining permission from the Bankruptcy Judge.
