English translation
If criminal proceedings for fraudulent or negligent bankruptcy are instituted, or a judgment thereon is rendered pursuant to the preceding Articles, preventive settlement, restructuring, declaration-of-bankruptcy, and composition proceedings shall retain their independence from the criminal proceedings, without being referred to the criminal court and without that court having the right to take cognizance of them, unless the law provides otherwise.

إذا أقيمت الدعوى الجزائية بالإفلاس بالتدليس أو بالتقصير أو صدر حكم بذلك
وفقاً لأحكام المواد السابقة، تظل إجراءات التسوية الوقائية وإعادة الهيكلة وشهر
الإفلاس والصلح محتفظة باستقلالها عن الدعوى الجزائية ، دون أن تحال إلى المحكمة
الجزائية، أو أن يكون من حق هذه المحكمة التصدي لها، ما لم ينص القانون على
