Article 93 of Bankruptcy Law

The bankruptcy judge may, upon an application submitted to him during the period following the decision amending the preventive settlement proposal and before completion of implementation of the proposal, decide to terminate the preventive settlement proceedings if either of the following two cases occurs: 1) If the debtor submits an application to terminate the proceedings on the basis that the conditions for opening preventive settlement proceedings no longer apply to him, or that the settlement proposal cannot be implemented in accordance with the terms of the proposal. (2) If the debtor or the supervisory authority submits an application to open restructuring proceedings or proceedings for a declaration of bankruptcy. The Bankruptcy Department shall notify the creditors, the Bankruptcy Committee and the supervisor, as applicable, of the application within ten days from the date of its submission. The bankruptcy judge shall issue his decision approving or rejecting the application within ten days from the date of its submission.
