Article 201 of Commercial Code

1 - The principal or passenger shall have the right of direct recourse against the carrier to claim compensation for damage arising from non-performance of the contract of carriage, its defective performance or delay. In this case, the commission agent for carriage must be joined in the proceedings. 2 - The carrier shall have the right of direct recourse against the principal passenger to claim compensation for the damage he sustained from performing the carriage.
