Article 199 of Commercial Code

1 - The transport commission agent guarantees the safety of the thing or passenger. 2 - In the carriage of things, he shall be liable, from the time he receives the thing, for its total or partial destruction, damage, or delay in its delivery. He may not disclaim liability except by proving force majeure, an inherent defect in the thing, the principal's fault, or the consignee's fault. 3 - In the carriage of persons, he shall be liable for delay in arrival and for bodily or material harm sustained by the passenger during performance of the contract of carriage. He may not disclaim liability except by proving force majeure or the passenger's fault. 4 - In all cases, he may have recourse against the carrier if there are grounds for such recourse.
