Article 227 of Commercial Code

1 - If a pledge is created over fungible property, it shall remain in force even if the pledged thing is replaced by another thing of its kind. 2 - If the pledged thing is non-fungible property, the pledgor debtor may recover it and replace it with another, provided that this is stipulated in the pledge contract and that Law Index 1285 Home Page Commercial Law Decree-Law No. 68 of 1980 Promulgating the Commercial Law the creditor accepts the substitute, without prejudice to the rights of third parties acting in good faith.
