English translation
1 - Acceptance of a bill of exchange constitutes a presumption that the acceptor holds funds for its payment. This presumption may not be rebutted in the relationship between the drawee and the holder. 2 - The drawer alone must prove, in the event of denial, whether or not the bill of exchange has been accepted, that the drawee held funds for its payment at maturity. If he fails to prove this, he shall guarantee payment even if the protest was drawn up after the time limit prescribed by law. If the drawer proves the existence of the funds and their continued existence until the time at which the protest should have been drawn up, he shall be discharged to the extent of those funds, unless they have been used for his benefit.

١ - يعتبر قبول الكمبيالة قرينة على وجود مقابل لوفائها لدى القابل، ولا يجوز
اثبات عكس هذه القرينة في علاقة المسحوب عليه بالحامل.
٢ - وعلى الساحب دون غيره أن يثبت في حالة الإنكار ، سواء حصل قبول الكمبيالة
او لم يحصل أن المسحوب عليه كان عنده مقابل وفائها في ميعاد الاستحقاق، فإن لم
يثبت ذلك كان ضامنا للوفاء ولو عمل البروتستو بعد الميعاد المحدد قانونا. فإذا
اثبت الساحب وجود المقابل واستمرار وجوده حتى الميعاد الذي كان يجب فيه
عمل البروتستو، برئت ذمته بمقدار هذا المقابل، ما لم يكن قد استعمل في مصلحته.Ask about this article
