Article 479 of Commercial Code

1 - The drawer and any endorser or guarantor by aval may exempt the holder of the bill of exchange from drawing up a protest for non-acceptance or non-payment when exercising his right of recourse, if he writes on the bill of exchange and appends his signature to a recourse clause (Recourse without expenses» or «without protest or any other phrase conveying this meaning. 2 - This clause shall not exempt the holder from presenting the bill of exchange within the prescribed time limits or from giving the necessary notices. Whoever invokes against the holder a failure to observe these time limits shall prove it. 3 - If the drawer writes this clause, its effects shall apply to all signatories; but if an endorser or a guarantor by aval writes it, its effects shall apply to him alone. 4 - If the drawer is the one who inserted the clause and the holder nevertheless draws up a protest, the holder alone shall bear the expenses. But if the clause originates from an endorser or a guarantor by aval, recourse for the expenses of the protest, if drawn up, may be had against all signatories.
