Article 540 of Commercial Code

1 - If a bearer cheque is lost or destroyed, its owner may lodge an objection with the drawee to payment of its amount. The objection shall include the cheque number, its amount, the name of its drawer, every other particular that assists in identifying it, and the circumstances surrounding its loss or destruction. If some of these particulars cannot be provided, the reasons therefor shall be stated. If the objector has no domicile in Kuwait, he shall designate an elected domicile therein. 2 - Once the drawee receives the objection, he shall refrain from paying the amount of the cheque to its possessor and set aside the funds for payment of the cheque until its matter is decided. - The drawee shall, at the objector's expense, publish the number of the lost or destroyed cheque, its amount, the name of its drawer, and the objector's name and address in the Official Gazette. Every disposition of the cheque occurring after the date of this publication shall be void.
