Whoever prints, publishes, broadcasts, promotes, sells, offers for sale or leaks, by any means whatsoever, questions or answers for examinations in governmental or non-governmental education at its intermediate or secondary stages, with the intent of cheating or facilitating cheating, disrupting the general order of examinations, or affecting the validity and integrity of their results, shall be punished by imprisonment for a term not less than two years and not exceeding five years, and a fine not less than one thousand dinars and not exceeding five thousand dinars, or by either of these two penalties. If the acts referred to in the preceding paragraph are committed by a person connected with supervising these examinations, preparing them, drawing them up, organizing them, transporting them, delivering them or safeguarding them, the penalty shall be imprisonment for a term not exceeding seven years and a fine not less than five thousand dinars and not exceeding ten thousand dinars, or either of these two penalties. In all cases, confiscation of the seized items used in the commission of the offence shall be ordered. The acts mentioned in the first paragraph shall not constitute an offence if they concern specimens of previous questions or answers used for training purposes or preparation for taking examinations. )2(

يعاقــب بالحبــس مــدة لا تقــل عــن ســنتين ولا تزيــد على خمــس ســنوات، وبغرامــة لا تقــل
عــن ألــف دينــار ولا تزيــد على خمســة آلاف دينــار، أو بإحــدى هــاتين العقوبــتين، كل
مــن طبــع، أو نشر، أو أذاع، أو روج، أو بــاع، أو عــرض للبيــع، أو سرب، بــأي وســيلة
كانــت أســئلة، أو إجابــات، اختبــارات التعليــم الحكومــي أو غير الحكومــي، في مرحلتيــه
المتوســطة أو الثانويــة، بقصــد الغــش أو تســهيله، أو الإخلال بالنظام العــام للاختبارات،
أو التــأثير على صحــة وسلامــة نتائجهــا.
فــإذا ارتكبــت الأفعــال المشــار إليهــا في الفقــرة الســابقة مــن شــخص له صلــة في الإشراف
على هــذه الاختبــارات، أو تحضيرهــا، أو إعدادهــا، أو ننظيمها، أو نقلها، أو تســليمها، أو
حفظهــا، تكــون العقوبــة الحبــس لمــدة لا تزيــد على ســبع ســنوات، والغرامــة التــي لا تقــل
عــن خمســة آلاف دينــار ولا تزيــد على عشرة آلاف دينــار، أو بإحــدى هــاتين العقوبتين.
وفي جميــع الأحــوال، يحكــم بمصــادرة الأشــياء المضبوطــة التــي اســتعملت في ارتــكاب
الجريمــة.
ولا تعــد الأفعــال المذكــورة في الفقــرة الأولى جريمــة إذا وقعــت على نماذج لأســئلة أو
