English translation
Every subscription made contrary to the preceding provisions shall be void, and any person with an interest may invoke this nullity. An action for nullity shall be time-barred upon the lapse of six months from the date subscription closes. If the nullity results from a criminally punishable act, the action for nullity shall not be time-barred until the criminal action is time-barred. A judgment of nullity may be rendered even if the company is in liquidation.

يقع باطلاً كل اكتتاب يتم خلافًا للأحكام السابقة، ويجوز لكل ذي مصلحة أن
يتمسك بهذا البطلان.
وتسقط دعوى البطلان بمضي ستة أشهر من تاريخ قفل باب الاكتتاب، فإذا كان
البطلان بسبب فعل معاقب عليه جزائيًا فلا تسقط دعوى البطلان إلا بسقوط
الدعوى الجزائية، ويجوز الحكم بالبطلان ولو كانت الشركة في حالة التصفية.Ask about this article
