Article 169 of Companies Law

If the reduction resolution is due to the capital exceeding the company's needs, the company must, before implementing the reduction resolution, pay debts that are due and provide sufficient guarantees for payment of deferred debts. If their due debts are not paid or the guarantees for deferred debts are insufficient, the company's creditors may object to the reduction resolution before the competent court in accordance with what the Executive Regulations prescribe in this regard.
