English translation
If the challenged judgment is set aside for nullity, and that nullity arises from a cause connected with service of the statement instituting the action, the court shall, together with its ruling of nullity, order the action remitted to the court of first instance for consideration after notifying the litigants, provided that the lodging of the challenge shall be deemed equivalent to service of the claims presented therein. )2(

إذا قضي بإلغــاء الحكــم المطعــون فيــه لبطلانــه، وكان هــذا البــطلان راجعــا لســبب يتصــل
بــإعلان صحيفــة افتتــاح الدعــوى فــإن المحكمــة تــقضي مــع البــطلان بإعــادة الدعــوى
إلى المحكمــة أول درجــة لنظرهــا بعــد إخطــار الخصــوم، على أن يعــتبر رفــع الطعــن في
