Article 5 of Code of Civil Procedure

All service of process shall, unless otherwise provided by law, be effected by process servers or enforcement officers. The process to be served shall be drawn up by the applicant, or by the lawsuits officer on the basis of information provided by him. The parties or their representatives shall provide such assistance as is possible to complete service. Subject to Article (10) of this Law, service shall be effected by electronic mail or any modern electronic means of communication capable of storage and retrieval, to be specified by decision of the Minister of Justice. This shall apply to personal status disputes and family disputes. If service by electronic mail or any modern electronic means of communication is not possible, the court may, of its own motion or at the request of a party, authorize service by the ordinary method. A decision shall be issued by the Minister of Justice, in coordination with the Public Authority for Civil Information or any other competent entity, specifying the conditions and controls governing service procedures, receipt thereof and electronic signature thereon, accredited websites, the entity accrediting signatures or other electronic data, the certification certificates it issues and the licence required for it in these cases. An electronic signature relating to service shall have the same effect prescribed for a signature in this Law and the Law of Evidence in Civil and Commercial Matters, provided that its creation complies with the technical and technological conditions and controls ensuring confidence in the various means, the integrity of authenticated information, the possibility of retaining the signed electronic instrument under conditions preserving its integrity, and the other technical controls specified by the aforementioned decision of the Minister of Justice. Entities, companies, establishments and individuals shall provide the Public Authority for Civil Information with mobile telephone contact details, electronic mail details or details of any approved electronic means of communication. The latest update of these details shall be relied upon.
