Article 78 of Code of Civil Procedure

A plea that the court lacks jurisdiction owing to the absence of its judicial authority or because of the type or value of the action may be raised at any stage of the action, and the court shall rule on it of its own motion. If the court rules that it lacks jurisdiction because of the type or value of the action, it shall order referral of the action in its current state to the competent court. It shall specify for the parties the hearing at which they are to appear before the court to which the action is referred. Pronouncement of the judgment shall constitute notice to the parties of the specified hearing. The court to which the action is referred shall be bound to hear it.
