Article 79 of Code of Civil Procedure

A plea for referral on grounds of connection may be raised before either court, and the court to which the action is referred shall be obliged to hear it. If the court orders referral, it shall specify for the parties the hearing at which they shall appear before the court to which the action is referred. Pronouncement of the judgment shall constitute notice to the parties of the specified hearing. Article 80 (1) Nullity of service of statements of claim and summonses arising from a defect in service, in the designation of the court, or in the date of the hearing shall be cured by the appearance of the person served at any hearing set for consideration of the action or by his depositing a memorandum of defense.
