Article 96 of Code of Civil Procedure

An application for a judgment declaring the lapse of the proceedings shall be submitted—by the ordinary procedures for bringing an action—to the court before which the action whose proceedings are sought to be declared lapsed is pending. The lapse of the proceedings may be invoked by way of a defence if the plaintiff resumes his action after the expiry of the year.
