Article 33 of Traffic Law

Without prejudice to the measures prescribed in this Law or any more severe penalty in any other law, anyone who commits any of the following acts shall be punished by imprisonment for a term not exceeding three months and a fine not exceeding three hundred dinars and not less than one hundred and fifty dinars, or either of these two penalties: 1. Driving a motor vehicle without a driving licence, or with a licence that does not authorise him to drive such a vehicle, or whose withdrawal or suspension of validity has been decided. 2. Driving a motor vehicle inattentively, endangering the lives or property of the driver, passengers or others. 3. Carrying out any repairs to any vehicle resulting from an accident without written permission issued by the competent authority at the Ministry of Interior. 4. Violating public morals in the vehicle. 5. Intentionally recording particulars contrary to the truth in an official form or application with the intention of obtaining a vehicle operating licence, driving licence, or any permit required by this Law or its Executive Regulations, or obtaining a copy or replacement for a lost one of any of them. 6. Failing to give way to government vehicles (police, ambulance, fire service, civil defence, official motorcades and their accompanying vehicles), or following them while they are using their sirens for the purpose of overtaking vehicles on the road. 7. Driving on the road shoulder. 8- Failure by drivers of transport vehicles of all types, industrial and construction vehicles, tractors, vehicles with trailers and vehicles with semi-trailers to keep to the right side of the carriageway, or overtaking other vehicles unnecessarily. 9. Using mobile communications devices or any other device by hand, or being distracted from the road while driving. 10. Driving a vehicle that emits disturbing sounds, dense smoke or an unpleasant 1( The final paragraph was added pursuant to Decree-Law No. 5 of 2025. odour, or from whose load materials fly off or from which materials flow that are flammable, harmful to health or affect the road’s fitness for use, or from whose load anything falls that poses a danger to road users, or which has accident damage affecting its balance, or whose tyres or one of them are unfit for use. 11. Anyone who flees or attempts to flee after committing a traffic accident resulting in damage to public property or the property of others. 12. Moving the vehicle with high acceleration such that the tyres emit a disturbing sound. )1(
