English translation
If the deposit is not lodged by the litigant required to lodge it or by any other litigant, the expert shall not be obliged to perform the assignment. The court may sentence the litigant required to lodge it to a fine of not less than fifty dinars and not more than one hundred dinars, while granting him a suitable period to lodge the deposit, or may decide that the litigant who has not paid the deposit forfeits his right to rely on the judgment appointing the expert if it finds that the excuses he has offered for this are unacceptable.

إذا لم تودع الأمانة من الخصم المكلف بإيداعها أم من غيره من الخصوم كان الخبير
غير ملزم بأداء المأمورية، ويجوز للمحكمة أن تحكم على الخصم المكلف بإيداعها
بغرامة لا تقل عن خمسين دينارا ولا تجاوز مائة دينار مع منحه أجلا مناسبا لإيداع
الأمانة أو أن تقرر بسقوط حق الخصم الذي لم يقم بدفع الأمانة في التمسك بالحكم
