Article 29 of Judicial Organisation Law

Judges related by blood or marriage up to the 4th degree may not sit in the same circuit. Nor may the representative of the Public Prosecution, the representative of a litigant or his defender be among those having the aforementioned relationship with any of the judges hearing the case. Chapter Four: Judicial Inspection Article 30 (1) A judicial inspection department shall be established to inspect the work of the deputy presidents and judges of the Court of First Instance, composed of a president and a sufficient number of counsellors. A judicial inspection department shall be established to inspect the work of the Chief Prosecutors and prosecutors of the Public Prosecution, composed of a president holding the rank of Advocate General and a sufficient number of Advocates General and Chief Prosecutors. The Supreme Judicial Council shall issue annually a decision seconding the president and members of each of the 2 aforementioned departments. The inspection system in both the courts and the Public Prosecution shall be issued by a decision of the Supreme Judicial Council. Article 31 (2) Inspection shall be conducted at least once every 2 years, and competence shall be assessed according to one of the following grades: : Competent / Above Average / Average / Below Average. The judge or member of the Public Prosecution shall be informed of all observations or papers placed in his service file. He shall also be notified by a copy of the inspection report and shall have the right to lodge a grievance with the Supreme Judicial Council within 15 days from the date of notification. The Supreme Judicial Council shall decide the grievance after reviewing the papers and hearing the statements of the complainant where necessary. The Inspection Department shall send a copy of the inspection report to the Minister of Justice and the Supreme Judicial Council immediately upon placing the report in the personal file.
