Article 38 of Judicial Organisation Law

The Supreme Judicial Council shall have jurisdiction to consider the pretrial detention of a judge or member of the Public Prosecution and the renewal of such detention, or to order another measure, subject to the safeguards provided for in Articles 69, 70 and 71 of the Criminal Procedure and Trials Law, unless the matter is being considered by the criminal court competent to hear the action, in which case that court shall have jurisdiction.
