Article 38 of Law on Combating Narcotic Drugs and Psychotropic Substances

The registers prescribed in this Decree-Law shall be retained for three years from the date of the last entry made therein. Import, export, transport and circulation licences, release licences, invoices relating to import and export, and medical prescriptions prescribed in this Decree-Law shall be retained for the same period from the date recorded on them. The paper documents specified in the first paragraph of this Article shall be destroyed after the expiry of Law Index 405 Home Page Law on Combating Narcotic Drugs and Psychotropic Substances Decree-Law No. 159 of 2025 concerning Combating Narcotic Drugs, Psychotropic Substances and Regulating Their Use and Trade Therein the period specified therein, by a committee formed by the Ministry which shall convene every three months or whenever necessary, provided that an electronic copy of those documents is retained. This copy shall have the same evidentiary force as the document from which it was taken. By a decision of the Minister, persons subject to the provisions of this Decree-Law may be required to keep registers electronically in addition to paper copies, provided that the electronic system for those registers ensures retention of all data that the paper registers undertook to retain, and access thereto upon request by officers vested with judicial enforcement powers.
