Article 44 of Law on Combating Narcotic Drugs and Psychotropic Substances

The penalty for the offences stipulated in the two preceding Articles shall be death if any of the following aggravating circumstances is present: 1- Recidivism. 2- If the offender, in carrying out his offence, enlists the assistance of a juvenile, a person suffering from mental illness or deficient mental development, a person acting in good faith or under compulsion, a person whose upbringing or care is entrusted to the offender, or a person over whom he has authority. 3- If the offender supplies narcotic or psychotropic substances or preparations to a juvenile for consumption. 4- If the offence occurs in prisons, police stations, rehabilitation centres, addiction treatment centres, places of worship, places designated for education, or sports clubs. 5- If the offender exploits his official authority to commit the offence or facilitate its commission.
