Article 75 of Law on Combating Narcotic Drugs and Psychotropic Substances

The Public Prosecution shall have jurisdiction over investigation, disposition, and prosecution in all offences and complaints provided for in this Decree-Law and offences connected therewith. The Criminal Court shall be competent to hear all those offences. The provisions of this Decree-Law shall apply to every person who commits, within the territory of Kuwait and its dependencies, an offence provided for herein. They shall also apply in the exclusive economic zone and to every person who commits, outside this territory, an act that makes him a principal offender or an accomplice in an offence committed wholly or partly within the territory of Kuwait. The provisions of this Decree-Law shall also apply to every Kuwaiti who commits outside Kuwait an act punishable under the provisions of this Decree-Law and under the provisions of the law in force in the place where the act was committed, if he returns to Kuwait without the foreign courts having acquitted him of the charges against him. However, if it is established that the foreign courts have convicted him and he has served his sentence in full, criminal proceedings shall not be instituted against him.
