Article 40 of Anti-Money Laundering Law

Without prejudice to the provisions of Articles (28, 29) of this Law and the rights of third parties acting in good faith, the court shall (in the event of conviction for any of the other crimes provided for in this Law order the confiscation of the following property and instrumentalities: 1 - The proceeds of the crime, including property commingled with those proceeds, resulting from them, or substituted for them. - Income and other benefits resulting from the proceeds of crimes. The property constituting the subject matter of the crime. The court may order the equivalent of the value of the property and instrumentalities mentioned in paragraphs (a), (b), and (c) whose whereabouts cannot be determined or which are unavailable for confiscation purposes. The property referred to in the first paragraph may not be confiscated if its owner establishes good faith by proving that he obtained that property for an appropriate price, obtained it in exchange for providing services commensurate with its value, or on other legitimate grounds, and that he was unaware of its illicit source. The death of the accused shall not preclude a judgment confiscating the property and instrumentalities pursuant to the provision of the first article.
