Article 108 of Capital Markets Authority Law

A court called the Capital Markets Court shall be established at the Court of First Instance. Its seat shall be determined by a decision of the Minister of Justice with the approval of the Supreme Judicial Council n. This court shall consist of the following: 1 - Criminal circuits having exclusive jurisdiction to adjudicate criminal actions relating to the offences provided for in this Law. The felony circuit shall be composed of three judges, at least one of whom shall hold the rank of counsellor, and the misdemeanour circuit shall be composed of a judge of at least the first grade. The rules and procedures prescribed in the Criminal Procedure and Trials Law shall be followed in investigations of criminal actions and their institution before those circuits, in matters for which no special provision is made in this Law. 2 - Non-criminal circuits having exclusive jurisdiction to act in non-criminal actions relating to commercial, civil, and administrative disputes arising from the application of the provisions of this Law and the rules and regulations specific to the securities market, and substantive enforcement disputes relating to judgments issued by them, regardless of the value of these disputes. These circuits shall be composed of three judges, at least one of whom shall hold the rank of counsellor. - One or more judges delegated by the Court of First Instance to rule provisionally, without prejudice to the substance of the right, on matters in which delay is feared and which fall within this court's jurisdiction, as well as interim enforcement objections, and to issue orders on petitions, interim orders, and payment orders relating thereto. The Civil and Commercial Procedure Law and the laws supplementing it shall apply to non-criminal actions brought pursuant to the provisions of this Law, in matters for which no special provision is made therein.
