Article 59 of Telecommunications Regulatory Authority Law

A- The employees vested with judicial enforcement status pursuant to the provisions of this Law and the regulations and decisions issued in implementation thereof shall be designated by decision of the Minister in coordination with the Authority. B- Without prejudice to the aforementioned Law No. 17 of 1960 and other laws in force in the State, the Authority's employees referred to in clause A of this Article shall have the power to monitor implementation of the provisions of this Law and the regulations, decisions and orders issued pursuant thereto. They shall have the right to enter places containing, or suspected of containing, telecommunications devices, networks or facilities or all or part of the infrastructure used in telecommunications services, to inspect them and seize any telecommunications devices or equipment that are unlicensed or unauthorized, used in an unlicensed activity, or whose use may interfere with or damage existing telecommunications systems. For that purpose, these employees shall have the right to: 1- Request and examine licences, books, registers, documents and all papers relating to telecommunications activity. 2- Inspect and examine any telecommunications devices, telecommunications facility or any other facilities connected with providing a telecommunications service or establishing, operating or owning a telecommunications network. 3- Access any other information or documents, in any form, connected with providing telecommunications services. C- The employees referred to in the preceding paragraph shall have the right to enter any aircraft, ship, boat or any vehicle landing or berthing in the State to inspect the telecommunications stations or radio telecommunications devices therein associated with a telecommunications frequency, or to examine the papers and documents relating thereto. D- No person may prevent or obstruct any employee vested with monitoring and inspection powers from performing the duties and exercising the powers stipulated in this Article. E- Civilian and military authorities and public security forces shall provide the Authority's employees vested with judicial enforcement status with all possible assistance to perform their work in detecting violations.
