English translation of the principle

The condition must be recorded in the marriage contract document. Article 41, Law 51 of 1984. The reason for that. To preclude disputes and falsehood in alleging and proving any such conditions. The consequence of that. None of these conditions is recognized if the contract contains none of them. - The absence of a presumed attribute in the woman does not give the man an option to rescind. Unless he expressly stated at marriage that he married her on condition that this attribute existed, or the woman is herself the fleeing one—who flees from one attribute to an attribute she does not possess—by telling the man that she possesses an attribute and being found otherwise than she described. - Virginity and previous consummation are attributes that must be stipulated in the marriage contract; presuming them is insufficient. The absence of a presumed attribute in the woman does not give the man an option to rescind unless he expressly stated and stipulated it when drawing up the marriage contract.
