A wife’s entitlement to consolatory compensation. Its case. The husband’s effecting divorce by his unilateral will without her consent, to redress the estrangement caused by the husband. It is not due to her where she requests divorce, where it occurs for a cause attributable to her, upon the husband’s insolvency, or upon the calamity of death. The reason for this. There is no estrangement or pain in a divorce effected with her consent. - 401 - Personal Status

استحقاق الزوجة للمتعة. حالته. إيقاع الزوج الطلاق بإرادته المنفردة دون رضائها وذلك لجبر إيحاش الزوج. عدم وجوبها لها حال طلبها الطلاق أو وقوعه بسبب منها أو عند إعسار الزوج أو مصيبة الموت. علة ذلك. لا إيحاش ولا ألم في طلاق تم برضائها. - ٤٠١ - أحوال شخصيةOriginal Arabic judgment citations
