Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 740

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The established rule in the school of Imam Malik, where spouses separate by irrevocable divorce, is that establishing parentage requires the wife to give birth within a year of the divorce and not to have acknowledged the expiry of the waiting period. A blood analysis conflicting with the Sharia rule establishing parentage through the marital bed renders it unavailing in the action.
