Kuwait Court of Cassation principle number 844

State of Kuwait · Personal Status · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The applicable rule of the Ja'fari school is that, if a woman becomes irrevocably separated from a man and has a child by him, then, if the child lacks discernment, she has the greater right to the child, without disagreement. If the child has discernment—which is upon reaching seven or eight years or above, up to puberty—then, if male, the father has the greater right to him.
