Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 100

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

State-owned industrial plots are not public property but are the State’s private property. Dealings therein are subject to the provisions of private law. Contracts concluded concerning them are not considered administrative contracts. The decision issued by the Municipality concerning their withdrawal from the allottee is not considered an administrative decision. Any dispute arising concerning allocation or withdrawal does not fall within the jurisdiction of the Administrative Circuit; rather, the Commercial Circuit has jurisdiction over it.
