Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 596

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Judicial review of the constitutionality of laws. Falls within the exclusive jurisdiction of the Constitutional Court. It extends to a ruling that a provision is unconstitutional, thereby abolishing its enforceability, or that it is constitutional and consequently free from defects and grounds of invalidity. - The Constitutional Court's prior ruling rejecting the plea of unconstitutionality of Law No. 41 of 1993 concerning the State's purchase of certain debts and the manner of their collection. Its res judicata effect is absolute, having conclusively resolved the dispute concerning the constitutionality of this Law and precluding the dispute over it from being raised anew.
