Kuwait Court of Cassation principle number 69

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A resignation request is merely an employee’s wish to leave his position voluntarily, by his own choice, and permanently; it is a right permitted to him, restricted by considerations relating to the public interest. In regulating it, the legislature reconciled the employee’s right to leave work with the proper operation of the public service. - An employee who has expressed his wish to leave work permanently by resignation must continue performing his work until the administrative authority notifies him of its acceptance. That authority must examine the resignation within thirty days of its submission; otherwise, it is deemed accepted by operation of law. An employee’s absence from work immediately after submitting his resignation, where the absence reaches either of the two limits stipulated in Article 81 of the Decree on the Civil Service Regulations. His being deemed resigned by operation of law. This does not entail automatic termination of the employee’s service pursuant to Civil Service Council Decision No. 3 of 1981.
