Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 920

State of Kuwait · Administrative Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Decisions to second and transfer employees. They fall outside the jurisdiction of the Administrative Circuit. Provided that they do not contain within them a decision falling within the jurisdiction of that Circuit, such as a decision embodying a disguised disciplinary penalty. The criterion is whether the administration intends by its decision to serve the public interest or to spite the employee or retaliate against the employee. What suffices in this regard.
