Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1110

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The offence of concealing a fact or disposition provided for in Article 23 of Law 41 of 1993 has its elements established by the offender's undertaking any of the acts or dispositions provided for, including concealing an existing fact or disposition, whenever this is accompanied by his intent to evade repayment of the indebtedness. - The judgment's conclusion that the elements of the offence, including criminal intent, exist against the appellant and are established against him in accordance with the law. The appellant's challenge in this regard. Factual argument inadmissible before the Court of Cassation. - The judgment's omission to respond to the appellant's manifestly invalid defence that he was free of indebtedness and lacked criminal intent. Does not vitiate it. Example. - 307 - Criminal Settlement of Transactions Relating to Company Shares Concluded on Deferred Terms (Law No. 75 of 1983)
