English translation of the principle

Mitigating circumstances, as a rule, affect only principal punishments, not ancillary or supplementary punishments, including removal from office, restitution and the proportional fine. The consequence thereof: refraining from pronouncing punishment in respect of these punishments is impermissible. Example: establishment of the offence of appropriation against a public official. Refraining from pronouncing punishment in respect of the principal punishment while imposing removal from office without restitution. No error.
