Kuwait Court of Cassation principle number 1732

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

A civil action is inadmissible before the Juvenile Court. Article 38 of Law 3 of 1983 concerning Juveniles. The reason for this: so that civil matters do not distract the Juvenile Court from its social function. Trial of the juvenile before another court. Its effect: removal of this prohibition. Establishment that the appellant and another juvenile were tried before the Felony Court and not the Juvenile Court. Its effect. Removal of the prohibition. Admissibility of the civil action ancillary to the criminal action. The objection thereto is unsound.
