English translation of the principle

Assessment of compensation. Within the authority of the trial judge so long as the law does not require him to follow specific criteria or methods concerning it, and provided that his ruling rests on sound and reasonable grounds and specifies the elements of the damage and the basis of the compensation claimant’s entitlement thereto. - Compensation for material damage. Its basis is impairment of the injured party’s financial interest and the damage being certain, having actually occurred or being certain to occur in the future. - Compensation for moral damage. It is sufficient that it be of an amount that consoles the injured party and ensures restoration of his standing, without exaggeration or excess in assessment and as the judge deems appropriate. - The court requested to award provisional compensation may award final compensation if it is established that the damage has definitively settled.
