Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 1751

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Acquittal because the charge is not established. Necessitates dismissal of the claim for compensation. The reason for this: there is no basis for a compensation action for an act not established against the person to whom it was attributed. - The judgment's conclusion acquitting the respondent because the charge was not established and dismissing the civil action. The appellant's challenge in this respect is unfounded.
