Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 251

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

An offence consisting of several acts. Anyone who intervenes in its execution is deemed a perpetrator therein, even if it was not completed by his act alone but was completed by the act of one or more of those who intervened with him therein. The condition for this: that he have the intention to intervene therein. - Criminal intent in the offence of forgery. The criterion for its establishment. Assessing whether or not it exists. Within the authority of the trial court. - Express and separate discussion in the conviction judgment of each element of the offence of forgery. Unnecessary so long as it sets out facts indicating them. An example of sound reasoning for considering the appellant a perpetrator together with others in offences of forging bank papers and fraud.
