Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 252

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The principal perpetrator. Is one who contributes to the crime by an act constituting it. - The appellant's driving of the car in which the victim rode, misleading him into believing that he would take him to his destination, then locking its doors and diverting it to an isolated area, and another person's threatening the victim with a knife and then pricking him with it to make him comply with his order to hand over his wallet, whereupon he complied with his demand under compulsion. Suffices to deem the appellant a principal perpetrator in the offence of theft using violence. The failure to seize the stolen property in his possession does not detract from this. The reason therefor.
