Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 299

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

Commission of an offense through several acts, whether by its nature or according to its execution plan. Its consequence: a person who has the intent to contribute or the intention to intervene therein is considered a principal perpetrator together with another, provided the offense occurred as a result of their agreement and he contributed to some extent to its execution according to the plan. The reason therefor: each of them shared his co-perpetrator's intent to commit the particular offense, even if it was not completed by his act alone but occurred through the act of one or more of those who intervened with him therein.
