The offense of indecent assault. It is established by the commission of any act violating the victim's sexual modesty and extending to the victim's body, touching any of the victim's private parts and offending the victim's sense of modesty in this respect. The act's leaving a mark on the victim's body. Is not required for this element to be present. Criminal intent therein is established by the perpetrator's will being directed toward committing the act constituting the offense, knowing that it violates the victim's sexual modesty. The judgment's addressing it separately. Is unnecessary, provided that the facts it sets out indicate its existence. - The element of force or threat in the offense of indecent assault. Its establishment: through all forms of absence of consent on the part of the victim. Its presence: through any coercive means employed against persons with the intention of disabling or eliminating their resistance to facilitate commission of the offense.
