Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 851

State of Kuwait · Penal Law · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The facts set out in the judgment and the evidence of guilt containing nothing warranting belief in the appellant's participation in forging the female victim's signature on banking facilities agreements, and its failure to state the limits of the appellant's agency in managing the victim's establishment, whether it authorized him to conclude those agreements on her behalf or not, and the effect thereof on establishing or negating the offence of fraud. Deficient reasoning and unsound inference requiring its cassation. This is not altered by the judgment's reliance on the appellant being the person interested in concluding those agreements, so long as there was no evidence of his participation in forging them and he denied committing it and knowing of it. - 239 - Penal
