Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 117

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The general rule is that procedural legal rules apply with immediate effect to actions brought while they are in force, even if those actions arise from earlier facts. - The first-instance judgment’s determination of a petition for reconsideration filed after the commencement of Law 51 of 1984, without the Public Prosecution’s intervention in a dispute concerning a person with limited legal capacity. The challenged judgment’s ruling that the first-instance judgment is void. Correct. The fact that the event underlying the dispute in respect of which reconsideration is sought predates the commencement of the said Law. It has no effect.
