Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2057

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court's obligation to examine a challenge alleging absolute simulation. Its condition: that its meaning be explicit in treating the apparent contract as having no existence in reality. Merely alleging fraud and collusion between the parties to a sale contract does not constitute evidence of its sham nature.
