Judicial principle — Kuwait Court of Cassation

Kuwait Court of Cassation principle number 2075

State of Kuwait · Civil Matters — Volume 10 · Ministry of Justice — Court of Cassation — Technical Office

English translation of the principle

The court’s obligation to examine a challenge based on absolute simulation. Its condition: that its meaning be explicit in treating the apparent contract as having no existence in reality. Merely alleging fraud and collusion does not constitute evidence of its simulation. - A manifestly invalid defence. No fault attaches to the judgment if it does not respond to it. Example of a plea that an acknowledgment is simulated.
